These Terms & Conditions apply to your use of the BoatsHaven website and buying service.
BoatsHaven is a boat buying service (“BoatsHaven”, “we”, “us” or “our”).
Contact: hello@boatshaven.com.
BoatsHaven provides a service for evaluating and potentially purchasing boats, watercraft, engines, trailers and related marine equipment.
We are not required to provide a valuation, make an offer or purchase any item.
Submitting an enquiry, communicating with us or providing information does not create a binding purchase agreement or require either party to complete a transaction.
Any valuation, estimate, indication of value or offer is provisional and non-binding unless we expressly state otherwise in writing.
We may revise or withdraw an offer before a binding purchase agreement is concluded, including after receiving additional information, inspecting the item or reviewing its documentation, ownership, condition, equipment or legal status.
Any offer is subject to any conditions stated with it.
A valuation or offer is not an independent appraisal or guarantee of market value.
We may request photographs, documents, additional information, remote inspection or physical inspection before deciding whether to proceed.
We may decline, revise or withdraw a proposed transaction if information is incomplete or inaccurate, the item differs from its description, required documentation is unavailable, ownership or third-party rights cannot be satisfactorily verified, or for other reasonable commercial or compliance reasons.
By submitting an item for consideration or entering into a transaction with us, you confirm that:
— you are the lawful owner or are legally authorised to sell the item;
— information and documents you provide are materially accurate and not misleading;
— you have disclosed material known defects and relevant information concerning the item; and
— you have disclosed any finance, lien, security interest, co-ownership, prior sale or other third-party right affecting the item.
Unless expressly agreed otherwise in writing, the item must be transferred free from undisclosed debts, liens, finance arrangements and third-party claims.
If information provided by the seller is materially inaccurate, incomplete or misleading, we may revise or withdraw an offer.
Where reasonably incurred costs or direct losses result from materially false or misleading information, undisclosed third-party rights, deliberate concealment or breach of these responsibilities, the seller may be responsible for those costs or losses to the extent permitted by applicable law.
A completed purchase is governed by the written purchase agreement for that transaction.
Unless expressly stated otherwise in writing, discussions, messages, valuations, offers, collection planning or other communications do not replace the purchase agreement.
If there is a conflict between these Terms and a signed purchase agreement, the signed purchase agreement prevails for that transaction.
Inspection, collection, transport and payment arrangements are agreed individually for each transaction.
Dates and timings are estimates unless expressly agreed otherwise in writing.
Before completing a transaction or releasing payment, we may require satisfactory verification of identity, ownership, registration, documentation, third-party rights and any other information reasonably relevant to the transaction.
The seller must provide reasonable and lawful access to the item and any documents or equipment agreed as part of the transaction.
Risk, ownership and payment terms are governed by the applicable purchase agreement.
If a seller cancels or fails to complete an agreed transaction after costs have reasonably been incurred in reliance on that agreement, we may seek recovery of applicable direct costs to the extent permitted by law and the relevant agreement.
Website content is provided for general information and may be changed, removed or updated without notice.
We do not guarantee that the website, its content or any feature will always be available, uninterrupted, error-free, complete or suitable for a particular purpose.
You must not misuse the website, submit deliberately false information, interfere with its operation or access it through unauthorised automated means.
Website content, branding, design and other protected material may not be commercially reproduced without permission unless applicable law allows it.
We may use independent service providers in connection with inspections, transport, payments, technology or other parts of our service.
To the extent permitted by applicable law, we are not responsible for delays, failures or losses caused by independent third parties or circumstances outside our reasonable control.
To the maximum extent permitted by applicable law, BoatsHaven is not liable for indirect, incidental, special or consequential loss, loss of profit, revenue, opportunity or anticipated savings arising from the website, our service or a proposed transaction.
Where liability relates directly to a completed purchase transaction, our total aggregate liability arising from that transaction will not exceed the purchase price under that transaction, to the extent such limitation is permitted by applicable law.
Nothing in these Terms excludes or limits liability where it cannot lawfully be excluded or limited.
We may update these Terms from time to time.
The version applicable to a particular completed purchase is subject to the terms of the relevant purchase agreement.
These Terms are governed by the laws of the Republic of Lithuania.
Disputes are subject to the jurisdiction of the courts of Lithuania, except where mandatory applicable law gives a party the right to rely on another jurisdiction or mandatory legal protection.
If these Terms are made available in another language, the English version prevails in the event of inconsistency, to the extent permitted by applicable law.
